Welcome to Allison Neiss Pottery. We sincerely appreciate your decision to shop with us. By placing an order through our website, you agree to the following terms and conditions. We’re committed to providing you with a seamless experience, so please review the details carefully. Thank you for supporting our handcrafted pottery – we’re excited to share our creations with you!

  1. In Stock Orders

    • In-Stock Items: All items in our inventory will be shipped within 3 days of your payment.

    • Cancellations: Cancellations must be requested before shipment. Once shipped, orders cannot be canceled and are non-refundable.

  2. Custom-Made Orders

    • Custom Orders: If a particular sculpture that caught your eye has already been sold or is featured in our gallery, I can craft a new piece inspired by the same style. However, each piece is uniquely handcrafted and shaped freehand, so no exact replica can be made. While a similar style can be achieved, the new piece will have its own distinct characteristics.

    • Size Modifications: You may request a sculpture in a different size (either smaller or larger) than the one currently available or previously sold. The overall design can be adjusted in scale, but artistic interpretation will influence the final piece.

    • Custom Glaze Requests: You may request a specific glaze that I have used previously. Note that glazes created using layered techniques will vary, resulting in no two pieces being exactly alike. Only glazes visible on the website are available for selection.

    • Order Customization Agreement: Understand that the shape, glaze, and size of custom orders will not be identical to previous works. This inherent variability is part of the charm and uniqueness of handmade pottery.

    • Payment Terms: Upon agreement of the custom order and price, a deposit of 50% of the maximum price is required upfront. Once the sculpture is completed, you will receive a picture of it. After the sculpture is fired with the desired glazes and if the firing goes well, you will pay the remaining amount and the sculpture will be yours.

    • Cancellation and Refund Policy: Once a custom sculpture is completed, it cannot be returned or canceled. If you choose not to proceed with the purchase after the sculpture is finished, both the sculpture and the deposit will be retained. The sculpture will then be available for sale to other buyers at a price I set. This policy is similar to that of a bespoke suit: once made, it cannot be returned.

    • Estimated Delivery Time: The typical timeframe for completing and delivering a custom sculpture is between 4 to 6 weeks. This period may vary based on drying time, firing cycles, and material availability. While I may begin sculpting promptly, the overall process requires time to ensure the quality and craftsmanship of the final piece.

    • Material Availability: If the necessary clay or glaze is not in stock, it will need to be ordered from abroad, which can affect the start time for creating your sculpture. Please plan accordingly and allow ample time for the creation and delivery process, especially if the sculpture is needed by a specific date or as a gift.

  3. Shipping / Return

    • Shipping Methods: Orders will be primarily shipped via USPS at your expense. Upgrading your shipping option will also be at your expense. Insurance is included with all orders.

    • Local Pick-up: If you live in the Charlotte, NC area or surrounding regions, arrangements can be made to pick up your pottery directly. Please contact us to schedule.

    • International Shipping: For international orders, please contact us. Customs duties or taxes may apply and are the buyer’s responsibility.

    • Tracking Information: You will receive an email with tracking details once your order has shipped.

    • Damaged Items: While we strive for perfection, handmade pottery may have unique imperfections. If your pottery arrives damaged, please contact us within 48 hours of receiving your package and provide clear photographic evidence of the damage. We will then process a refund or exchange as appropriate.

  4. Product Disclaimer

    • All pottery items are handmade and may vary slightly in color, shape, and size. These variations are part of the unique character of handmade items and are celebrated.

    • All pottery is food, dishwasher, and microwave safe unless otherwise specified. However, handwashing is encouraged to extend the life of your piece.

  5. Indemnity

    • By using this site and purchasing products from Allison Neiss Pottery, you agree to indemnify, defend, and hold harmless Allison Neiss Pottery and its affiliates, employees, agents, and suppliers from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.

  6. Limitation of Liability

    • Allison Neiss Pottery will not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use the materials on this site or the performance of the products, even if Allison Neiss Pottery has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, business interruption, or loss of data. In no event shall the liability of Allison Neiss Pottery exceed the amount paid by you for the specific product that gave rise to the claim.
